Mr. Ding Jiajia, Master of Laws, is a partner and lawyer of ShangHai YingDong Law Firm, a member of Shanghai Law Society and a part-time tutor of Shanghai University of Finance and Economics. Prior to joining ShangHai YingDong Law Firm, he has worked for Luther Rechtsanwaltsgesellschaft mbH Shanghai Office and Dentons Shanghai Office.
Mr.Ding has a solid theoretical foundation and rich practical experience in corporate governance, corporate litigation and commercial, financial disputes resolution. He has participated in the compilation of the chapter “Disputes over Equity Transfer” in the book “The Lawyer’s Practice in Corporate Litigation” published by the Shanghai Lawyers Association. He has participated in the establishment of equity structure, equity incentives, and internal rules and regulations of many companies, and has also handled many disputes related to companies such as disputes over capital contribution of shareholders and over equity transfer.
In commercial disputes resolution, Mr. Ding has served for many famous enterprises such as Shanghai SuNing and ANZ Bank, and has achieved remarkable results in handling of related lease contract and bulk trade disputes, furthering hundreds of millions of interests for his clients.
Mr.Ding is deeply rooted in the financial leasing field. Clients he serves include Shanghai GuoJin, ChuangGe and ZhongTou JunAn. He provides the daily business compliance and liquidation service for these enterprises, and has represented in dozens of financial leasing dispute cases, with satisfying results.
• Representative performance
Representing a well-known media company in a dispute over shareholders' capital contribution. In this case, Mr. Ding’s client has breached the contract. By rigorous investigation, Mr. Ding identified loopholes in the counterparty's evidence, successfully convincing the tribunal to rule that both the two parties have breached the investment agreement, greatly mitigating the liability that his client should have bear.
Representing a famous e-commerce company in a dispute over lease contracts. In this case, Mr. Ding received the counterparty's evidence one day before the trial. Through thorough investigation and analysis, he finally found the loopholes in the evidence. During the trial the next day, he successfully demonstrated that the third party constituted an unauthorized agency, thus the lease has not expired and his client has not breached the contract. He perfectly reversed the situation and forced the counterparty to withdraw the lawsuit.
Representing a famous e-commerce enterprise in a disputes over contracts for implementation of construction projects. In this case, Mr.Ding successfully demonstrated that the counterparty's evidence is insufficient to prove that he constitutes the actual builder through the rigorous legal argument. The court finally dismissed the counterparty's claim.
